Patient Disclaimer

OmniStem facilitates connections between patients, doctors, and scientists with licensed medical professionals who offer umbilical cord-derived mesenchymal stem cell treatments outside the United States and Canada as part of their clinical practice.

Since stem cell therapy is not recognized as a standard of care in the U.S. or Canada, the following disclosures are essential for all individuals considering this therapy:

1. The field of adult stem cell treatment is in its early stages.
2. The U.S. FDA has not evaluated the treatments described on OmniStem.com, and they are not considered standard care for any condition or disease.
3. Significant and unknown risks may be associated with adult stem cell treatments, as long-term studies have not yet been conducted.
4. No prospective, randomized clinical trials for most diseases have been conducted using adult stem cells, so no guarantee of safety or effectiveness is implied or stated.
5. Licensed doctors will only perform treatments after the patient has provided informed consent.
6. If accepted for treatment, it will not take place in the USA or Canada, but in Colombia or Dominican Republic.
7. Applications may take up to four working days to review from the date of submission.

Treatment Fees

• This is not a clinical trial.
• Health insurance does not cover treatment fees.
• OmniStem does not provide itemized bills.
• A fee will be quoted once your treatment protocol has been determined.

Medical Services Facilitation Agreement and General Release

In the United States, OmniStem engages in medical tourism and services marketing. We provide access to excellent stem cell care and other medical services in Colombia. OmniStem’s sole purpose is to facilitate connections between patients and medical professionals who help guide decisions on medical treatment.

The patient acknowledges that OmniStem acts solely as a facilitator and is not a treating physician or healthcare provider. OmniStem does not perform any treatments or procedures. The patient confirms that they have conducted their own due diligence and have chosen to seek therapy without any influence or pressure from OmniStem.

Price and Payment

The patient will pay OmniStem the amount specified on the digital invoice for the services outlined.
Total price includes estimated service costs but does not cover unforeseen expenses related or unrelated to the procedure.
Full payment must be received 14 days before the scheduled treatment date. If full payment is not made, the treatment may be canceled.

Non-Refundable Deposit

Upon signing this agreement, the patient will pay a non-refundable deposit of USD 1,500 unless otherwise agreed upon.

Description of Services

OmniStem will facilitate the treatments or services described in the invoice. Services are subject to change based on medical discretion.

Dispute Resolution

OmniStem will attempt to resolve any issues with third-party service providers (such as doctors, airlines, or hotels). However, disputes unresolved in good faith will need to be addressed directly between the patient and the service provider.

Governing Law and Venue

This agreement is governed by the laws of the Republic of Colombia, and the proper venue for any legal proceedings will be Pereira, Colombia.

Confidentiality

All patient medical records received by OmniStem will be kept confidential in secure electronic files.

Release of Liability

The patient acknowledges that OmniStem serves only as a facilitator and coordinator. The patient assumes all risks of harm, whether foreseen or unforeseen, and accepts full responsibility for their safety throughout the treatment process.

Attorneys’ Fees

In any legal action to enforce this agreement, the prevailing party will be entitled to recover all costs, including reasonable attorneys’ fees.

HIPAA Email Consent

By consenting, you agree to the use of unencrypted email communication with the understanding that third parties may intercept such communication.

Refund Policy

Due to the nature of stem cell preparation, all payments are non-refundable after a 24-hour cancellation grace period, except for the non-refundable deposit of USD 1,500.

No-Show and Cancellation Policy

Patients must give 30 days’ notice to reschedule treatments. Otherwise, payments are non-refundable.
